Terms and conditions
These terms cover the sound packs we make, the license you receive when you buy one, delivery and support. Your payment is taken by a merchant of record, the company named as the seller at checkout. Section 1 explains who does what. Please read section 5 before you buy: once the download is made available to you, your right of withdrawal ends.
1. Who you are dealing with
We are JRM-Studios, owner Johannes Riedl, Oberer Steinweg 9, 75438 Knittlingen, Germany (“we”, “us”). Streaming Sounds is an unregistered brand of JRM-Studios and not a legal entity of its own. Our full details are in the legal notice. We make the sound packs, we grant you the license, we deliver your download and we answer your support requests.
The sale itself is concluded with a merchant of record: the company named as the seller on the checkout page and on your receipt, which takes your payment, issues your receipt and accounts for any value added tax, GST or sales tax. At the time of writing that company is the merchant of record operated by Stripe and shown at checkout as Link.
These terms apply to the sound packs, the license, delivery and support. The merchant of record’s own terms, which it shows you at checkout, apply to the payment and to the sale. Any terms of your own that conflict with these apply only if we have agreed to them in writing.
2. How the contract comes about
The presentation of sound packs on this website is not a binding offer. By completing the checkout you make a binding offer to buy the packs in your order.
Two things then come about at once: a contract of sale with the merchant of record, and the license described in section 6, which we grant you. Both take effect when your payment is confirmed. The merchant of record sends you a receipt; we send you an email with your download link.
We store the text of these terms and of the license agreement as they stood at the time of your purchase, and will send them to you again on request.
If you are under 18, you may only buy with the consent of a parent or guardian, and with their authorization for the payment method used.
3. Prices, discounts and payment
The prices shown on this website are the prices you pay. They include value added tax, GST or sales tax where such a tax applies to your purchase; where none applies, the price is the same. The tax is worked out at checkout from the billing address you give, and the merchant of record collects it and accounts for it to the relevant tax authority.
Prices are in US dollars. If your card or account is in another currency, your bank or card issuer may convert the amount and charge its own fees for doing so.
When you buy several packs in one order, a discount applies automatically: 10% off each pack for two packs, 25% off each pack for three or more. The discount is shown in your cart and applied at checkout. It applies to the packs in a single order only.
Which payment methods are available is shown at checkout. We never see or store your card or account details.
4. Delivery
Our sound packs are digital content, delivered as a download. After payment you receive an email with your download link. Each pack is one ZIP file containing every sound as a WAV file (48 kHz, 24 bit) and as an MP3 file, and the license agreement as a PDF. You need nothing beyond a program or service that can play or import WAV or MP3 files.
The download link is valid for three days and may be used three times per file. That is generous enough for a failed transfer, and short enough that a link passed on to someone else is worth nothing. Please download your pack and keep your own backup of the files.
Need it again later? Write to hi@streaming-sounds.com from the email address you bought with, or quote your order reference, and we issue a new link. We do this for as long as the pack is in our catalogue, and we do not charge for it.
5. Right of withdrawal
If you are a consumer, you have the right to withdraw from the purchase within fourteen days without giving any reason. The period begins on the day the contract is concluded.
Because the sale is concluded with the merchant of record, a withdrawal is addressed to it; the details are in the terms it shows you at checkout and on your receipt. You may also send your statement to hi@streaming-sounds.com and we pass it on without delay. Sending it before the period expires is sufficient to meet the deadline. Where you withdraw in time, all payments received from you are refunded without undue delay and no later than fourteen days after the statement is received, using the same means of payment you used, at no charge to you.
When the right ends. Because these are digital contents supplied without a physical medium, your right of withdrawal expires once performance has begun, that is once the download is made available to you, provided that you have expressly asked the seller to begin before the withdrawal period ends and have confirmed that you understand this ends your right of withdrawal. You give both before you pay, by ticking the box in the cart or in the buy dialog, where the seller is named. We record its wording and the time you gave it, and we repeat both in the email that carries your download link, so that you have them in writing. Until you tick it, checkout does not start.
The merchant of record may operate its own refund practice that goes further than your statutory rights. Nothing in these terms restricts that, and nothing in them restricts your statutory rights as a consumer.
Model withdrawal form
You do not have to use this form, an email saying what you have decided is enough, but you may if you prefer. Complete and return it only if you wish to withdraw.
To the seller of your order, whose name and address are shown on your receipt. You may also send this form to JRM-Studios, Inh. Johannes Riedl, Oberer Steinweg 9, 75438 Knittlingen, Germany, or by email to hi@streaming-sounds.com, and we pass it on without delay.
I/we (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the supply of the following digital content:
Ordered on (*) / received on (*):
Order reference:
Name of the consumer(s):
Address of the consumer(s):
Signature of the consumer(s) (only if this form is notified on paper):

6. Your license
All sounds sold here are protected by German copyright law, and we hold the rights to license them. On full payment you receive from us a simple, non-exclusive, perpetual right to use the sounds in the pack you bought, within the limits of the license agreement. We grant that license ourselves, whoever processed the sale.
What the license allows and what it does not is set out in our license agreement. It forms part of our agreement with you and you can read it in full before you buy. The same text travels inside every download. Where these terms and the license agreement differ, these terms apply.
7. If something is defective
Statutory rights in respect of defects apply and are not restricted by these terms. Where your purchase is concluded with the merchant of record, your statutory claims in respect of the sale lie against it.
In practice, write to us. We made the pack, so we are the ones who can put it right, and we will. If a pack does not have the agreed condition, because files are missing, corrupted or do not match the list on the pack page, tell us and we fix or replace it.
The character of a sound is not a defect. The previews on each pack page let you hear every alert in full before you buy.
8. Updates and continued conformity
Where the law requires it, you receive the updates needed to keep what you bought in conformity with the contract, for as long as you may reasonably expect for a product of this kind. We commit to two years from the day of your purchase: within that period we correct faults in our files and make the corrected version available to you at no charge through the support address.
The sounds are plain WAV and MP3 files. They need no software of ours and will keep working in any program or service that can play them.
9. Liability
This section concerns our own acts and omissions: the sound packs, the license, delivery and support.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
For slight negligence we are liable only where we breach an obligation that is essential to the proper performance of our agreement with you and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage that was foreseeable and typical for this kind of agreement.
Any further liability is excluded. This does not alter the burden of proof to your disadvantage.
10. Support and availability
We answer support requests sent to hi@streaming-sounds.com as soon as we can. The support page shows what helps us answer in one reply.
We cannot guarantee that this website is reachable at all times. Maintenance, faults at our hosting provider, failures of networks we do not operate and events outside our control may interrupt it. Interruptions of this kind do not affect packs you have already downloaded.
11. Applicable law and jurisdiction
German law applies to our agreement with you, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only in so far as it does not deprive you of the protection of mandatory provisions in the country where you are habitually resident. Which law governs your contract of sale with the merchant of record is set out in its own terms.
If you are a merchant, a legal person under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the place of jurisdiction for all disputes arising from these terms is Knittlingen, Germany. As a consumer, you are not affected by this: you may always bring proceedings, and will always be sued, at the court for the place where you live.
12. If part of this is invalid
Should any provision of these terms be or become invalid, the remainder stays in force. The statutory provisions then apply in place of the invalid provision.
